Shared Tenancy

Hi All
I am 65 years old and live in a Council House with my 40 year old Daughter who has Downs Syndrome and a congenital heart disease, I have started thinking about what would happen to my Daughter when I die, so asked the local housing office if she could be put as a joint tenant with me to make sure she could take over the tenancy from me when the time comes. I was told NO! After my demise they will assess her needs and take it from there.! I feel so upset that I can't make any definate plans for her future now, it seems to me I will either have to put her in residential which I don't want for her neither does she, or leave her to the SS to do with her what they want.

Has anyone had any experience of this if so how did you deal with it ?

Have you checked your tenancy agreement? Usually one succession to the tenancy is allowed so if you were the original tenant and not a joint tenant with a partner who has predeceased you your daughter could have the right to carry on the tenancy after you.

I would also ask the advice of either a housing law solicitor or go to your local CAB. I think that MENAP, the name have changed I can't keep up with all the name changes, or the Downs Association would also be worth contacting, I'm sure that they deal with these sorts of problems regularly but I would make sure that you've checked the terms of your tenancy before contacting anyone so that you know what they state.
