Iv been on sick from my little partime job at the hospital and now got a incapitity form from my imployer to fill in ,im not sure if i will get sick money from being or intitled to incapitity benefit for iv only been off work since january this year and i know i can not return to my job ,iv come to terms being a carer of my young daughter and partner and cant take anything else on for it was too much for me and made be badly depressed which im now alot better .Could anyone advise me if i should go down this way and not just go onto carers allowance ,really not sure what to do.Help will be great if anyone can give it here bye for now , caroline

Tue 1 Jul 2008 20:50Caroline, I think as the law stands once your Statutory Sick Pay from your employer ends you can then claim Incapacity Benefit but this depends on your national insurance contributions over a certain period of time. Your Department of Work and Pensions local office should have a disability advisor who is obliged to advise you of all your entitlements. Would it be better if you did claim Carers Allowance as you may then get an element of Income Support with all the fringe benefits of free school meals, free prescriptions etc. If you dont want to talk to DWP at this moment your CAB should be able to advise you and even help with any claims. Hope you get sorted soon as financial problems will only undermine your health again. Nightingale

Tue 1 Jul 2008 22:47The way I understand it is that you should claim Income Support first anyway -if you are entitled to Incapacity benefit then it replaces that amount of IS -unless the amount of Income Support is higher. I would find out how much IS you would be entitled to and add it to the carers allowance - you might be better off as well as getting free prescriptions etc. If you are on IS you can also get a fixed price for your water if the person you care for needs to use more water than normal because of their disability ie more washing and laundry.

Wed 2 Jul 2008 08:00Hi Caroline, incapacity benefit is a higher rate than carers, you would be entitled to incapacity benefit if you are incapacitated (but not disabled) preventing you from going to work now and in the near future but not permanent, you will not get help with dental/perscriptions but may be able to get help with council tax and/or tax credits. You need to score 15 points if your illness affects your physical health, 10 points if your illness affects your mental health, 15 points if your illness affects your mental AND physical health, you do not have to score all of these just satisfy one catergory. I just started a part time job on a 'permitted work' scheme as i have been on incapacity benefit for 6 years, i had my annual medical assesment in May and got my results through the post yesterday..... they stopped my benefit on the opinion of 1 doctor who i had never met before!!!
I would be more than happy to work through your forms with you if you ask Michelle for my e-mail address, trust me dont think you'll manage by your self ok if someone offers help take it i wish i had!!!

Wed 2 Jul 2008 08:07PS i was told by my incapacity benefit advisor to appeal as she is well familiar with my case and just as shocked as i was that it was stopped but i wanted to return to work and as 'normal' a life as possible any way so decided not to, besides it takes ages and wouldn't get any benefit in the mean time so im making up the loss with overtime! so if i piss myself at work then so be it
if i pass out sitting at the till then tuff
they'll find out then that, that doctor is a twat and doesn't know what hes on about eh
